YTB and several of its executives are being sued in the U.S. District Court for Southern Illinois, by past travel agents who claim the company was operating as an illegal pyramid scheme and employing an illegal chain referral sales technique in violation of Illinois Consumer Fraud and Deceptive Business Practice Act.
The suit, filed on August 8, 2008, in names two specific plaintiffs, but seeks class action status on behalf of potentially more than 1,000 people who were members of the YTB travel network.
The defendants are YTB International Inc. and affiliated services, YourTravelBiz.Com, YTB Travel Network Inc., YTB Travel Network of Illinois, Rezconnect Technologies, and the principals of the firm, including founder and head J. Lloyd Tomer and company executives J. Scott Tomer, J. Kim Sorensen, Andrew Cauthen and Michael Brent. The case is pending.
According to filings with the Security and Exchange Commission, for the first quarter of 2008, only 12.5% of YTB’s net revenue was derived from the online sale of travel, while almost 80% came from the recruitment of people to join their online travel business. Based on the number of RTAs listed in these filings, the average amount made by each RTA through the sale of travel through their Web site for the first quarter was $27.75; on pace for a yearly income of $111. It costs an RTA about $600 a year for the upkeep of their Web site, not including the initial $449.95 start-up fee.
In addition, the International Air Transport Association Network (IATAN) confirmed that their relationship with YTB was severed due to “failure to maintain standards of accreditation.” YTB disputed IATANS actions, but upon review the actions were upheld.
